Multiple fraudster receives 14 months prison sentence

Mr C, a leading figure in Manchester’s Asian community, was today given a custodial sentence of 14 months for a total of six offences of fraud by false presentation – including a charge for insurance fraud that was brought against him by Allianz – at Minshull Street Crown Court, Manchester.

Mr C was one of the main organisers of a large outdoor Mela – a two-day Asian festival – held annually in one of Oldham Council’s municipal parks. On 7 July 2012 a lorry, delivering a large TV screen for the event, reversed into and damaged one of the stone pillars in the park. Cunningham Lindsey was appointed by Allianz, motor insurers for the company making the delivery, to handle the third party claim.

Neil Hanson, Complex Loss Investigator for Cunningham Lindsey, explains: “It was a relatively straightforward claim for third party damage to Oldham Council property, with presented repair costs totalling around £31,000. It seemed odd that payment was being made directly to Mr C and so we decided to investigate further with Oldham Council. We were informed that the required repairs had already been carried out and payment of the Council’s invoice – approximately £2,000 – had been received directly from Mr C and his foundation. Mr C had clearly submitted false and grossly inflated invoices to insurers against this claim. But it didn’t end there.

“During our meeting, the Oldham Council representative happened to mention that they had also been approached by another claims investigator who was looking into a much larger claim for around £100,000, involving Mr C and the Mela event. During subsequent meetings, we uncovered a range of other discrepancies and decided that this was a matter for the Police to investigate. All the information on Mr C’s activities was then passed on to the Greater Manchester Police Fraud Investigation Team and they have spent the last four years collecting the required evidence to bring Mr C to justice.”

Unfortunately this case is an example, which highlights that a small minority of people will go to extreme lengths for their own financial gain. It’s a great shame that such a popular and successful community event will now have associations with a fraudster”.

Storm Angus – the first UK named storm of the season brings heavy rain

On Sunday, Storm Angus brought winds of over 80mph, which battered southern areas of the UK. It was reported that over 1,000 homes, mainly in Devon, suffered power cuts and flooding immediately affected South Molton, Braunton, Bradiford and Swanage.
The storm moved away into the North Sea, but heavy rain has continued across the South West and tracked it’s way north throughout Monday.
Rivers in other parts of the country – the Midlands, across the North East and North West, Wales and the east of England – are now swollen and there are numerous flood warnings in place.
A passenger ferry was stranded at sea overnight and many roads have been closed. Rail travel in many areas has been affected. Network Rail warned yesterday that no mainline trains to or from London will be arriving or departing from Exeter for the next couple of days as parts of the mainline track have been washed away. Rail services have been similarly affected in the north of England and the Lake District.

Flood Warnings
As at 5pm yesterday, the Environment Agency warned that areas in Devon and the South Coast, the Midlands and the North East are at risk of flooding with 16 flood warnings – flooding is expected immediate action required – in place. There are also 111 flood alerts in force in many areas across England.
WeatherNet Warning
WeatherNet’s modelling, using the Environment Agency’s flood warnings, shows that over 1,000 UK properties are currently at risk of flooding (see map right).

HelpLine
On Sunday, our out-of-hours emergency HelpLine service saw an 85% increase in calls, compared to the previous Sunday. Around half of all calls were received between 6am and 12pm – by the afternoon, volumes of new calls had levelled off. The last time HelpLine received this volume of calls was on 6 December 2015, following Storm Desmond.

Ahead of the weekend, we had resourced our HelpLine service claims handling teams in line with the weather forecast information provided by both WeatherNet and the Met Office. It wasn’t until Saturday that the Met Office formally recognised Storm Angus, however, it seems that the call volumes have been disproportionate to the actual damage caused.
In response to the continued heavy rain and current risk of flooding, our HelpLine will be resourced to handle twice the normal volume of claims throughout today and overnight tonight and into tomorrow morning.

Claims Centres
Incoming claims numbers have so far been relatively low and initially from property owners mainly in areas of Cardiff, Exeter, Plymouth, Worthing, Folkstone, Towcester, South Buckinghamshire, Wiltshire, Northwood, Sittingbourne and Guernsey. These claims volumes are currently easily manageable and are being processed swiftly. National Adjusting Teams All our adjusters across the UK are ready to respond and assist customers who have experienced property damage due to Storm Angus and any subsequent flooding.

We will issue another update on Storm Angus when or if claims volumes should increase significantly.

Cunningham Lindsey are pleased to announce the arrival of Tony Ryan, Trevor Cameron and Alasdair Cameron into our Construction & Engineering and Home Foreign teams.

Tony is a dual qualified chartered civil engineer and also a fully qualified loss adjuster. He has worked in loss adjusting since 1990, having previously spent many years in the construction industry. Tony specialises in dealing with CAR/EAR losses. His wide range of experience varies from dealing with highway, bridge and tunneling projects, including many other major civil engineering infrastructure projects. Tony has worked in the UK, Europe, South America, Far East and Australasia. Tony Joins our Construction & Engineering team based in London.

Trevor is an honours graduate and a qualified adjuster with over 40 years’ experience in Loss Adjusting. He has lived and worked on five continents, acquiring extensive experience of Construction and Construction Liability claims worldwide, as well as project management. Trevor joins our Home Foreign team based in London.

Alasdair has over six years of adjusting experience, which he gained directly following university having studied forensic science. During his time occupying his first role in the insurance industry he worked in a construction team and developed his growing understanding of property and liability claims. Alasdair monitored several large projects both in the UK and abroad. He handled the majority of claims that fell within the Delegated Authority Schemes and managed the respective bordereaux for all these accounts. Alasdair joins our Home Foreign team based in London.

Maina Wagiciengo joins FAS Global in Glasgow

Cunningham Lindsey is pleased to announce that Maina Wagiciengo has joined FAS Global.  As Senior Manager, based in Cunningham Lindsey’s Glasgow office, Maina will undertake economic loss quantification engagements of varying scope, working alongside the company’s Major Loss Team in the region.

Maina was previously with Charles Taylor Adjusting Energy division, where he was responsible for quantifying financial losses primarily relating to offshore and onshore energy claims.  Prior to this, he was Senior Accountant at MDD Forensic Accountants, where he trained and qualified.

Maina has a wealth of experience in business interruption related assignments, including loss of profits, increased costs of working and damaged and destroyed stock recoveries.  He’s also worked on fraud investigations and economic loss assignments associated with litigated disputes. Specialist industry areas include oil and gas, mining, paper and pulp, power generation, textiles, hotels & resorts, retail, ports and terminals and petrochemicals.

Cunningham Lindsey expands UK Complex Loss & Motor Investigation teams

Cunningham Lindsey has promoted two new experts and recruited a motor claims specialist for its Complex Loss & Motor Investigation teams in the UK.

Stephen Feeney joins the Leeds team as a complex loss specialist.  Stephen has been with the business for over nine years, previously working as a casualty adjuster.  Prior to that he was a commercial property and liability adjuster with Buckley Scott and senior liability claims handler with AXA before that.

Simon Wheeler joins the team in Bristol as a complex loss specialist.  Simon has similarly been with the business for some nine years and prior to this new appointment, was a liability adjuster.  He will primarily provide support on losses around the M5 and M4 corridors, as well as Devon, Cornwall, South Wales and Birmingham.

Noel Blaney joins the company as Motor Investigations Team Leader.  Noel has 24 years motor insurance experience, having worked for DirectLine previously as a team leader, working on both personal lines and commercial motor claims across the UK.

Update: Hurricane Matthew

Cunningham Lindsey are responding to the passage of Hurricane Matthew in the Bahamas and are readying ourselves for it making landfall in the US.

In the Bahamas, Andrew Wilson, previously our Bahamian country manager, has a team of 5 adjusting and surveying staff already in Nassau.

We are in a centrally located location in Nassau and will be in a position to respond immediately following the passing of the storm in the event that access is limited or delayed as far as incoming flights are concerned.

Further staff are readied for deployment early next week.

In the US, Cullen Sophy, Cunningham Lindsey’s Head of MCL in the US, is coordinating our CAT team preparedness for the arrival of Matthew in Florida. We also have drone deployment capability which we are readying for use if required as well.

FAS Director to moderate Alternative Dispute Resolution seminar

Forensic Advisory Services’  Director, Litigation and Dispute Services, Daniel Djanogly will moderate a Chartered Institute of Arbitrators (London Branch) seminar hosted by Reynolds Porter Chamberlain (RPC) on 7 June. Anyone interested in attending should register using the details below.

Arbitration, mediation and other forms of Alternative Dispute Resolution (ADR) offer parties, amongst other things, privacy, control over the proceedings, procedural flexibility and choice of dispute resolver. The promise in principle is a quicker and cheaper route to binding resolution compared to formal court based litigation proceedings. However ADR in practice must contend with the choices made by the parties in terms of, for example, how they have contractually provided for the application of ADR in their business relationships, the procedural rules to be adopted, and their attitude and behaviour before, during and after the procedure. As a result ADR too suffers complaints particularly in terms of cost, time consumption, unpredictability and uncertainty. From their unique perspectives and based on their extensive experience serving the dispute resolution needs of the insurance industry, our distinguished panel of speakers will address “What do Insurers need out of ADR?” Audience participation in the discussion will be welcome and time will be provided for this.
